Please read these Terms of Service carefully before using PlayOutside adventure services. By booking or participating in our activities, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of PlayOutside's adventure tourism services, including but not limited to rock climbing, water sports, bushwalking, and related outdoor recreation activities provided by PlayOutside ("Company", "we", "us", or "our"). By engaging our services, you ("Client", "you", or "your") enter into a legally binding agreement with PlayOutside.

Your participation in any of our activities constitutes acceptance of these Terms in their entirety. If you disagree with any part of these Terms, you must not participate in our activities and should contact us immediately to cancel your booking.

2. Service Description

PlayOutside provides guided outdoor adventure experiences across Australia, including:

  • Rock climbing and abseiling instruction and guidance
  • Water sports activities including rafting, kayaking, and aquatic adventures
  • Bushwalking and trekking expeditions
  • Multi-day adventure packages and wilderness camping
  • Corporate team building and custom adventure experiences

All activities are conducted by qualified and certified instructors in accordance with Australian safety standards and industry best practices. We reserve the right to modify, cancel, or reschedule activities due to weather conditions, safety concerns, or other circumstances beyond our control.

3. Booking and Payment Terms

Bookings are confirmed upon receipt of full payment or agreed deposit. Payment methods include credit card, bank transfer, or other approved methods as specified during booking. All prices are quoted in Australian Dollars (AUD) and include GST where applicable.

Deposit requirements vary by activity type and duration. Multi-day expeditions typically require a 50% deposit at booking with the balance due 14 days before the activity commencement date. Single-day activities require full payment at booking unless alternative arrangements are made.

Late payment may result in booking cancellation and forfeiture of deposits. Additional fees may apply for last-minute bookings or special arrangements made within 48 hours of activity commencement.

4. Cancellation and Refund Policy

Client cancellations must be made in writing via email or phone. Refund eligibility depends on the notice period provided:

  • More than 14 days: Full refund minus 10% administration fee
  • 7-14 days: 75% refund
  • 3-6 days: 50% refund
  • Less than 3 days: No refund unless transferred to another date

PlayOutside reserves the right to cancel activities due to insufficient bookings, weather conditions, or safety concerns. In such cases, clients will receive a full refund or alternative date options. We are not liable for any additional costs incurred by clients due to our cancellations.

5. Risk Acknowledgment and Safety

Outdoor adventure activities involve inherent risks including but not limited to physical injury, property damage, or in extreme cases, death. Clients acknowledge these risks and participate voluntarily at their own risk. All participants must complete a comprehensive risk acknowledgment and medical disclosure form prior to activity participation.

Clients must disclose any medical conditions, medications, physical limitations, or previous injuries that may affect their ability to safely participate. Failure to disclose relevant medical information may void insurance coverage and result in immediate activity termination without refund.

Safety equipment is provided and must be used as directed by instructors. Clients who fail to follow safety instructions or behave in a manner that endangers themselves or others may be removed from activities without refund.

6. Insurance and Liability Limitations

PlayOutside maintains comprehensive public liability insurance and professional indemnity coverage as required by Australian law. However, clients are strongly advised to obtain their own travel and personal accident insurance prior to participation.

Our liability is limited to the maximum extent permitted by law. We accept no responsibility for loss or damage to personal property, travel delays, accommodation issues, or consequential damages arising from activity participation or cancellation.

Claims must be reported within 48 hours of occurrence with full documentation. Our maximum liability is limited to the amount paid for the specific activity in question.

7. Participant Code of Conduct

All participants must conduct themselves in a manner that ensures the safety and enjoyment of all group members. Unacceptable behavior includes but is not limited to:

  • Intoxication from alcohol or drugs during activities
  • Harassment, discrimination, or abusive behavior toward staff or other participants
  • Deliberate damage to equipment or environment
  • Failure to follow instructor guidance or safety protocols

Violation of our code of conduct may result in immediate removal from activities without refund and potential legal action for damages.

8. Environmental Stewardship

PlayOutside is committed to sustainable tourism practices and environmental conservation. Participants agree to follow Leave No Trace principles and respect local wildlife, vegetation, and cultural sites. Activities may be modified or relocated to minimize environmental impact.

Littering, damage to natural environments, or harassment of wildlife is strictly prohibited and may result in activity termination and additional charges for environmental restoration.

9. Privacy and Data Protection

Personal information collected during booking and participation is governed by our Privacy Policy. We use client information solely for service delivery, safety management, and legitimate business purposes. Photos and videos taken during activities may be used for marketing purposes unless clients specifically opt out.

Medical and emergency contact information is kept confidential and used only for safety and emergency response purposes.

10. Terms Modifications

PlayOutside reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with the effective date clearly indicated. Continued use of our services after Terms modification constitutes acceptance of the updated Terms.

Significant changes affecting existing bookings will be communicated directly to affected clients with reasonable notice.

11. Governing Law and Disputes

These Terms are governed by Australian law and the laws of the state or territory where activities take place. Any disputes arising from these Terms or activity participation will be resolved through Australian courts or alternative dispute resolution processes.

We encourage clients to contact us directly to resolve any concerns before pursuing legal action. Most issues can be resolved through direct communication and goodwill.
